Google, Oracle file names of paid journalists in court

SAN FRANCISCO: Oracle and Google responded on Friday to a judge's request for the identity of all writers who commented on the companies' intellectual property lawsuit, and who received money from the tech giants.

But while the post-trial order from US district judge William Alsup earlier this month had riveted tech and legal circles, the companies' responses contained no bombshells.

"Neither Google nor its counsel has paid an author, journalist, commentator or blogger to report or comment on any issues in this case," the internet search company said in its court filing.

Alsup's highly unusual order came months after the companies had squared off at trial, which featured testimony from high-profile technology executives including Oracle chief executive Larry Ellison and Google CEO Larry Page. The case attracted heavy media coverage from the mainstream press and technology-focussed blogs.

In his order, Alsup said he was "concerned" about relationships between commentators and the companies, but the judge did not reveal what specifically prompted him to act.

Oracle on Friday said it had hired blogger Florian Mueller, who often comments on patent issues, as a consultant on "competition related matters." However, Oracle said it retained Mueller after he began writing about the litigation.

"He was not retained to write about the case," Oracle said.

In an email to Reuters, Mueller noted he had previously disclosed the Oracle connection on his blog. "It's a consulting relationship, not a pay-for-blog relationship," he said on Friday.

In its court filing on Friday, Oracle also said some employees might have blogged about the case, but said it did not ask for or approve such posts.

Oracle sued Google in federal court in 2010, claiming the latter's Android mobile platform violated its patents and copyright to the Java programming language. It sought roughly $1 billion on the copyright claims.

Earlier this year, after the jury decided in Google's favor, Alsup ruled Oracle could not claim copyright protection on most of the Java material that Oracle took to trial. Oracle has said it will appeal.

Oracle also criticised Google for funding certain trade associations, whose staff then wrote about legal issues in play during the litigation. In its filing, Google acknowledged contributions to various groups but said it has not paid any of them to comment on issues in the case.

The case in US District Court, Northern District of California, is Oracle America, Inc v Google Inc, 10-3561.

Leveraging a Lexicon for Early Church Studies, Part I

Today?s guest post is by?Isaiah Hoogendyk, language editor for the content innovation department.

A couple weeks ago, I wrote about a great way to expand your understanding of the Church?s early apostolic witness. By studying the Apostolic Fathers (AF), you can better grasp the context of the teachings Our Lord gave the apostles before His death and resurrection, and you can deepen your comprehension of the world in which the apostles and earliest Church leaders lived.

And for those who want to go deeper still, I discussed how studying the Apostolic Fathers? original Greek text informs your understanding of the New Testament?s language. So now that your appetite for early Church exegetical studies is whetted, allow me to tell you about what is considered by many the definitive lexicon for New Testament Greek studies.

It is officially known as A Greek?English Lexicon of the New Testament and Other Early Christian Literature, so you can probably understand why people have picked a shorter title when talking about this illustrious compendium. But why ?BDAG? (i.e., ?bee-dag?)? Because these are the initials of the four lexicographers who made it happen: Bauer, Danker, Arndt, and Gingrich. Thanks especially to Danker (who, sadly, passed on earlier this year at the ripe age of 91), the BDAG has several excellent features.

First, it often distinguishes between two or more sense definitions for each Greek word. For each of these senses, there is given an ?extended definition? (in bold directly following the sense number), which helps to explain unambiguously how the word should be understood in English, and a ?formal equivalent? (in bold and italics after the extended definition), which gives a parallel English gloss in as few words as possible. For instance, the Greek lemma ???? has three distinct senses. The first sense includes the extended definition ?a living creature, wild or domesticated, but not including plants.? Following this is the formal equivalent, ?animal.?

Second, it includes numerous links to pertinent New Testament references (in bold), as well as Old Testament, Josephus, and Philo references and citations of key classical Greek texts. But the BDAG lexicographers didn?t stop there: they also included Apostolic Fathers references, linked, as always, to the appropriate locations. See, for instance, under the first sense above, ?Hb 13:11? followed by ?1 Cl 20:4, 10; 33:3; B 10:7f.? The first is a reference to the book of Hebrews, while the others link directly to, respectively, the First Epistle of Clement and the Epistle of Barnabas.

But wait; does this mean the BDAG includes all Greek words found in the AF, whether or not they appear in the NT? Yes. In fact, when you study the original Greek text of the AF, or use a reverse interlinear, you will be able to find a useful and lucid definition for every Greek word. This is crucial, considering that there are over 1200 words in the Apostolic Fathers not found in the NT.

Here?s an example of one of those words. The Catechism of the Catholic Church cites numerous AF passages. In paragraph 2240, the Catechism addresses our role in the world, specifically our duty to submit to secular authorities: this is, in fact, quite scriptural, being addressed by St. Paul in his first letter to Timothy (1 Tim. 2:2f). This notion was further expounded by the writer of the Epistle to Diognetus, who says that God has assigned the Church a ?noble position? in the world, comparing this role to how the soul ?holds the body together.? He then says that Christians are ?not allowed to desert it [the noble position].?

Here, the word ?allowed? is ???????. When we look it up in the BDAG, we see that this word does not occur in the NT. However, when we run a lemma search for this word in the same resource (the AF), we find that it occurs in only one other verse in the AF?1 Clement 63.1:

Therefore it is right (???????) for us, having studied so many and such great examples, to bow the neck and, adopting the attitude of obedience, to submit to those who are the leaders of our souls, so that by ceasing from this futile dissension we may attain the goal that is truly set before us, free from all blame.

So, by using the contextual info, along with the extended definition provided in the BDAG, we learn that ??????? has the sense of ?pertaining to being appropriate or right, with implication that the thing so described is not a matter of codified law but unwritten procedure based on custom and awareness of the transcendent.?

THERE'S a new weapon in the battle against blindness, and it's bright orange. A sweet potato bred naturally to contain loads more beta carotene than its traditional counterparts has helped stave off vitamin A deficiency in thousands of Ugandans. The announcement comes as other results confirm that beta-carotene-packed genetically modified rice can also boost dietary vitamin A effectively. Beta carotene is converted into vitamin A in the body.

About half a million children in Africa and Asia go blind every year because their diet contains too little vitamin A, which is vital for vision and the immune system. Of those who lose their sight, two-thirds die within months.

Aid agencies currently treat the deficiency by giving children high-dose capsules of vitamin A twice a year, but supplying the missing vitamin through locally grown food would be more practical and sustainable.

Enter the sweet potato. The orange flesh of a standard sweet potato betrays its beta-carotene content - the same stuff responsible for the carrot's hue. The new strain has four to six times the beta-carotene of an average sweet potato.

A two-year project involving 10,000 households in Uganda found that vitamin A intake doubled in women and in children aged 6 to 35 months who ate the improved sweet potatoes compared with families that continued eating regular varieties. By the end of the project almost 90 per cent of the kids eating the new strain had escaped vitamin A deficiency, compared with just 50 per cent in a control group.

"There's great potential for these potatoes," says Christine Hotz of the International Food Policy Research Institute in Washington DC, who headed the Ugandan project (Journal of Nutrition, DOI: 10.3945/jn.111.151829).

More controversial than the naturally bred sweet potatoes is Golden Rice - genetically engineered to contain 30 micrograms of beta-carotene per gram. Ordinary rice has none.

Critics had claimed that the rice is impractical. According to calculations by Greenpeace, people would need to eat huge amounts - as much as 18 kilograms of cooked rice a day - to obtain enough vitamin A.

A study involving 68 Chinese children demolishes the criticism. Guangwen Tang of Tufts University in Boston, Massachusetts, and colleagues have demonstrated that just 100 to 150 grams of the rice - about half the children's daily intake - provided 60 per cent of the recommended daily intake of vitamin A.

The children were given beta-carotene either in the rice, in pure form in oil, or in spinach. All the beta carotene they received contained isotopes enabling any vitamin A made from it to be distinguished from vitamin A that was already circulating in their blood.

Analyses showed that it took 2.3 grams of beta-carotene derived from rice to make a single gram of vitamin A - only marginally less efficient than making it from oil, which took 2 grams (American Journal of Clinical Nutrition, DOI: 10.3945/ajcn.111.030775).

"The conversion rate can't get better than that," says Adrian Dubock, project manager for the Golden Rice Project. He hopes that Golden Rice will eventually become widely available, despite objections. "It's been a long haul, but the new results give us confidence we're on the right track," he says.

I wouldn't do it that way again. In fact, in the last couple of years I've changed my approach a bit - and shortly thereafter, I broke out on my own as a freelance copywriter, and have started working with some of the biggest names in direct marketing as a result. p>

What change did I make? Well, in short, I started investing in copywriting courses as well as the books. I've let loose a little bit, and told myself that because I'm investing in my business and my career, I can afford to stretch to take courses that will help me become a better copywriter, and run a better copywriting business.

And, the copywriting courses have helped. A lot.

What You Get From Copywriting Courses

That You Won't Get From Books

Let me tell you a little bit about books, before I move on to copywriting courses.

Most copywriting books are advertisements for the copywriter's services. It's a not-so-secret secret. Write a book, be seen as an expert. Be seen as an expert, get hired - and at higher prices, too.

Sure, there are some good books. Ones I strongly recommend other copywriters read. Yet, most books seem to fall short by quite a bit when it comes to becoming successful as a copywriter. Because those books are designed to show off all that the copywriter knows about how to write good advertising. They're not designed to show you all the thinking you need to have to succeed as a copywriter.

Yet, it's the thinking that sets great copywriters apart from good copywriters... And, this thinking is what I've found to be the biggest takeaway from the best-of-the-best copywriting courses out there.

So, let me answer three of the most common questions around the copywriting courses out there... With the hope that I can steer you in the right direction for a successful career.

Question 1: "How Do You Evaluate Copywriting Courses?"

When it comes to copywriting courses, I look to the teacher of the course as my single-biggest factor. And, I have one big question.

"Do they walk the walk?"

Let me use a quick story to illustrate. A famous copywriter got a call from a new potential client. This client was trying to sell a book about " How to get rich with your own mail order business." The advertisement wasn't working well enough, so he turned to this copywriter for help.

So, this copywriter asked, "Have you gotten rich with your own mail order business?"

Can you guess what the answer was? "No." He hadn't. How much stock could anyone put in his advice, then? What was the value of learning how to get rich in mail order, from someone who hadn't done it themselves?

There are crooks and charlatans all over the place who talk the talk, but who don't walk the walk. When I'm looking to invest in a new copywriting course, I ask, "Have they done it? Have they succeeded as a copywriter?"

If the answer is, "No," that's my answer to buying the course. Yet, if they have... If the copywriter who's teaching the course is an already-successful copywriter... Then I can make the investment confidently.

Beyond this, when you're evaluating copywriting courses, I recommend looking for courses tha t teach two additional items beyond just how to write a good advertisement.

I recommend courses that also help you learn the entire marketing process of getting customers, maximizing customer value, and creating entire marketing strategies - because this helps a good writer become a strategic partner, which can skyrocket your income.

I also recommend courses that help you promote and market yourself as a copywriter - because a copywriter who can write blistering sales copy yet who can't get and keep clients has no chance of long-term success.

Question 2: "What Choices Are There In Copywriting Courses?"

It seems like just about every day a new copywriting course comes on the market. So, the choices are seemingly endless.

Yet, if you use the "walks the walk" criteria, you'll find that 80% of the copywriting courses available for purchase can be ignored completely. And, of the 20% that are left, only 20% of those are going to meet my other two criteria - teaching you marketing strategy and how to succeed in your copywriting career.

And, while opportunity seekers may gravitate to the promise of "How to write a million-dollar advertisement," the people who will find the most success will be those who learn "How to be a pro copywriter, A-to-Z."

So, that narrows down your choices to the select few copywriters (and there really is just a select few) who have proven themselves over and over again in the marketplace by writing winning advertisements.

And then, those who make it a point to teach you more than how to write a good ad - to those who also share marketing insights and strategy, as well as tips and recommendations on how to achieve maximum success as a copywriter.

I hope you do what I did and finally choose to pull the trigger and move forward on investing in yourself. Invest in good copywriting courses. At some point or another, a lot of people have thought Usher?s ex-wife Tameka Raymond was a little crazy, but not necessarily in the medical sense of the word ? I don?t think. Well, the same can?t be said of Usher?s legal team who brought in an expert psychologist to lend his opinion of Tameka?s mental state. In a lot of ways, Usher?s lawyers got Tameka to drive the nail in her own coffin, questioning her about less-than affluent times when she wrote bad checks to survive and stole for her and her baby. According to Rhymes with Snitch Tameka testified:

?Yes, I stole things. Please, I stole diapers before. I?ve gone in 7-Eleven and stolen diapers out of the store. I admit it, I was 19 years old, I?m not proud of it. I wouldn?t do it now.

?When I lost my jobs and didn?t have work, it was me and my crying baby at home. Just the two of us.?

At 41-years-old and a two-time industry man divorcee, Tameka certainly has no need for stealing diapers now, but that doesn?t mean her mind isn?t still in the wrong place, let Usher?s people tell it. In their closing arguments, they brought up testimony from a?licensed?psychologist who determined that Tameka suffers from:

?moderately severe mental disorder.?

I certainly hope those remarks came from a true expert and weren?t just a last-ditch effort to place the odds of obtaining full custody of his kids in Usher?s complete favor. Either way, these two have been in court long enough that a judge should be able to see-through the legal trick if that?s the case. If Tameka really is dealing with a mental disorder of some kind, that no doubt would have shown up in one of their numerous court proceedings. Despite Tameka seemingly putting Usher through the ringer during this custody battle, and him doing the same, it seems really?insensitive?to throw out this allegation, particularly after she lost her son just last month.

It can take decades to cause liver damage, and many people don't know they're harboring the blood-borne virus. Baby boomers account for about two-thirds of the 3.2 million Americans thought to be infected.

Previously, testing was recommended only for people considered at highest risk. It's most commonly spread today by sharing needles to inject illegal drugs.

The Centers for Disease Control and Prevention proposed the new guidelines earlier this year and made them final on Thursday. CDC officials took the step after seeing a near doubling of hepatitis C deaths since the late 1990s.

Once company telescopes spot a mining prospect, there's only one way to determine what resources the asteroid contains: Get close.

The Planetary Resources team envisions a swarm of prospecting bots heading out to conduct close flybys of near-Earth asteroids (NEAs). "We're talking about building interplanetary probes at a fraction of the cost [of current models], which requires doing things very differently," Diamandis says. NASA has used this form of propulsion twice for deep-space exploration. It uses electricity to positively charge xenon atoms, which are pulled out of the craft by magnets. The repulsive force provides thrust that propels a vessel, building speed over the course of years. It takes a while, but when it gets going the craft can exceed 200,000 mph.

The asteroids of interest likely will be less than 1 mile in diameter, too small to have appreciable gravity. Spacecraft don't land on such small asteroids; they dock to them. The prospecting craft might also tag the asteroid by planting a radio beacon on its surface. According to company officials, the beacon would do more than help future missions get a fix on an asteroid's location. "Placing a beacon is part of building a case for ownership," Diamandis says.

A private company's claim to an asteroid is uncharted legal territory. In the next decade lawyers may have to factor in the presence of private-sector entrepreneurs in the Outer Space Treaty, first signed in 1967 and ratified by more than 100 nations. If it turns out that possession really is nine-tenths of the law, then a simple radio transmitter could help make the miner's case.

Afghan meeting with jailed Taliban leader denied

The Afghan embassy in Islamabad on Tuesday denied reports that Afghan government representatives had met with a key Taliban commander imprisoned in Pakistan to discuss peace negotiations.

"No such meeting has taken place. We completely deny any meeting between Mullah Abdul Ghani Baradar and Afghan officials," Zardasht Shams, spokesman for the Afghan embassy in Islamabad, told AFP.

A source close to Mullah Baradar's family told AFP that Afghan delegates were not given access to Baradar in jail but family members had passed him a message from the Afghan government on reconciliation.

Baradar, a powerful Taliban military chief who has been described as the insurgents' second in command was arrested in 2010 in Pakistan.

At the time, the Afghan government and the former UN envoy to Afghanistan said his detention had adversely affected efforts to talk to the insurgents in a bid to end the decade-long Afghan war.

Mohammad Ismail Qasimyar, a member of Afghanistan's High Peace Council, on Monday said Afghan government officials and members of the Afghan embassy in Pakistan held secret talks with Baradar in prison two months ago.

A Pakistani security official confirmed Monday an official delegation from Afghanistan had made an initial contact with Baradar two months ago, but the Pakistani government later denied a meeting.

"The news reports about a meeting between Afghan officials and Mullah Baradar are baseless and incorrect," said the Pakistani interior ministry in a short statement issued late Monday.

President Hamid Karzai has long sought to negotiate with the Taliban but the Islamist militia has in public refused to deal with his administration, branding it an American puppet.

(AP) ? Squealing tiger cubs stuffed into carry-on bags. Luggage packed with hundreds of squirming tortoises, elephant tusks, even water dragons and American Paddlefish. Officials at Thailand's gateway airport proudly tick off the illegally trafficked wildlife they have seized over the past two years.

But Thai and foreign law enforcement officers tell another story:?officials working-hand-in-hand with the traffickers ensure that?other shipments through Suvarnabhumi International Airport are whisked off before they even reach customs inspection.

It's a murky mix. A 10-fold increase in wildlife law enforcement actions, including seizures, has been reported in the past six year in Southeast Asia. Yet, the trade's Mr.Bigs, masterful in taking advantage of pervasive corruption, appear immune to arrest and continue to orchestrate the decimation of wildlife in Thailand, the region and beyond.

And the region's honest cops don't have it easy.

"It is very difficult for me. I have to sit among people who are both good and some who are corrupt, says Chanvut Vajrabukka, a retired police general. "If I say, 'You have to go out and arrest that target,' some in the room may well warn them,'" says Chanvut, who now advises ASEAN-WEN, the regional wildlife enforcement network.

Several kingpins, says wildlife activist Steven Galster, have recently been confronted by authorities "but in the end, good uniforms are running into, and often stopped by bad uniforms. It's like a bad Hollywood cop movie."

"Most high-level traffickers remain untouched and continue to replace arrested underlings with new ones," says Galster, who works for the FREELAND Foundation, an anti-trafficking group.

Galster, who earlier worked undercover in Asia and elsewhere, heaps praise on the region's dedicated, honest officers because they persevere knowing they could be sidelined for their efforts.

???Recently, Lt. Col. Adtaphon Sudsai, a highly regarded, outspoken officer, was instructed to lay off what had seemed an open-and-shut case he cracked when four years ago he penetrated a gang along the?Mekong River smuggling pangolin.

?? This led him to Mrs. Daoreung Chaimas, alleged by conservation groups to be one of Southeast Asia's biggest tiger dealers. Despite being arrested twice, having her own assistants testify against her and DNA testing that showed two cubs were not offsprings from zoo-bred parents as she claimed, Daoreung remains free and the case may never go to the prosecutor's office.

?? "Her husband has been exercising his influence," says Adtaphon,?referring to her police officer spouse. "It seems that no policeman wants to get involved with this case." The day the officer went to arrest her the second time, his transfer to another post was announced.

?? "Maybe it was a coincidence," the colonel says.

???In another not uncommon case, a former Thai police officer who tried to crack down on traders at Bangkok's vast Chatuchak Market got a visit from a senior police general who told him to "chill it or get removed."

"I admit that in many cases, I cannot move against the big guys," Chanvut, the retired general, notes. "The syndicates like all organized crime are built like a pyramid. We can capture the small guys but at the top they have money, the best lawyers, protection. What are we going to do?"

Chanvut's problems are shared by others in Southeast Asia, the prime funnel for wildlife destined for the world's no. 1 consumer -- China where many animal parts are consumed in the belief they have medicinal or aphrodisiacal properties.

Most recently, a torrent of rhino horn and elephant tusks has poured through it from Africa, which suffers the greatest slaughter of these two endangered animals in decades.

Vietnam was singled out last month by the World Wide Fund for Nature (WWF) as the top destination country for the highly-prized rhino horn.

Tens of thousands of birds, mostly parrots and cockatoos plucked? from the wild, are being imported from the Solomon Islands into Singapore, often touted as one of Asia's least corrupt nations, in violation of CITES, the international convention on wildlife trade.

?According to TRAFFIC, the international body monitoring wildlife trade, the imported birds are listed as captive-bred, even though it's widely known that the Pacific Ocean islands have virtually no breeding facilities.

Communist Laos continues to harbor Vixay Keosavang, identified as one of the region's half dozen Mr. Bigs, who has been linked by the South African press to a rhino smuggling ring. The 54-year-old former soldier and provincial official is reported to have close ties to senior government officials in Laos and Vietnam.

Thai and foreign enforcement agents, who insist on anonymity since most work undercover, say they have accumulated unprecedented details?of the gangs, which are increasingly linked to drug and human trafficking syndicates.

?? They say a key Thai smuggler, who runs a shipping company, has a gamut of law enforcement officers in his pocket, allowing him to traffic rhino horns, ivory and tiger parts to China. He frequently entertains his facilitators at a restaurant in his office building.

?? According to the agents, Chinese buyers, informed of incoming shipments, fly down to Bangkok, staying at hotels pinpointed by the agents around the Chatuchak Market, where endangered species are openly sold. There they seal deals with known middlemen and freight operators.

?? The sources say that when they report such investigations seizures are either made for "public relations," sink into a "black hole" -- or the information is leaked to the wrongdoers.

?? Such a tip-off from someone at Bangkok airport customs allowed a trafficker to abort shipment of a live giraffe with powdered rhino horn believed to be implanted in its vagina.

??"The 100,000 passengers moving through this airport from around the world everyday are oblivious to the fact that they are standing in one of the world's hottest wildlife trafficking zones," says Galster.

???Officials interviewed at the airport, one of Asia's busiest, acknowledge corruption exists, but downplay its extent and say measures are being taken to root it out.?

Chanvut says corruption is not the sole culprit, pointing out the multiple agencies which often don't cooperate or share information. Each with a role at Bangkok's airport, are the police, national parks department, customs, immigration, the military and CITES, which regulates international trade in endangered species.

With poor communication between police and immigration, for example, a trader whose passport has been seized at the airport can obtain a forged one and slip across a land border a few days later.

?? Those arrested frequently abscond by paying bribes or are fined and the case closed without further investigation. "Controlled delivery" -- effectively penetrating networks by allowing illicit cargo to pass through to its destination -- is rare.

Thailand's decades-old wildlife law also awaits revision and the closing of loopholes, such as the lack of protection for African elephants, and far stiffer penalties.

???"The bottom line is that if wildlife traffickers are not treated as serious criminals in Southeast Asia we are just going to lose more wildlife," says Chris Shepherd, TRAFFIC's Southeast Asia deputy director. "How often is anyone arrested? They just run off, they must be the fastest people on earth."

?? Chalida Phungravee, who heads the cargo customs bureau at Suvarnabhumi, says just the sheer scale makes her job difficult. The airport each year handles 45 million passengers and 3 million tons of cargo, only some 3 percent of which is X-rayed on arrival. The main customs warehouse is the size of 27 football fields.

?? But seizures are made, she said, including boxes of tusks -- the remnants of some 50 felled elephants -- aboard a recent Kenya Airlines flight declared as handicrafts and addressed to a nonexistent company.

???"We have cut down a lot on corruption. It still exists but remains minimal," she said, citing recent computerization which has created a space -- dubbed "the Green Line" -- between customs officials, cargo and traffickers.

???Galster says unlike the past, traffickers are no longer guaranteed safe passage, describing a daily battle at Suvarnabhumi with "undercover officers monitoring corrupt ones and smugglers trying to outwit them all."

???Such increased enforcement efforts in the region have slowed decimation of endangered species, he says, "but there is still a crash going on. If corruption is not tackled soon, you can say goodbye to Asia's tigers, elephants and a whole host of other animals."

Convince the court that Apple's claim to the inventions are invalid, and that the technology was developed prior to the disputed patent's filing. It's called showing "prior art," and Sammy's done it before -- famously showing a scene from 2001: A Space Odyssey in an attempt to put Apple's iPad design claims to rest. Today's examples were more grounded in reality, focusing on debunking Cupertino's claim to the "bounce back" effect that happens when a user reaches the end of a page and common multitouch zoom / navigation gestures.

Samsung pitted the famous "bounce back" feature against an old PocketPC interface called LaunchTile, which allowed users to navigate through 36 applications by zooming in and out and a panning across a grid-like "world view" of said apps. Movement between grids snap to each zone, marking the end of a page. Apple shot back, noting that LiveTile's snapping navigation didn't work on diagonals, and cited other differences as well. Samsung wasn't deterred, however, and brought out DiamondTouch, a projector based multitouch table that utilized both one touch scrolling and pinch-based zoom gestures. The table even takes aim at the aforementioned bounce-back patent with a technology called TableCloth, which bounces back images that are pulled off screen. DiamondTouch's creator, Adam Bogue, told the court that he had demoed the technology to Apple privately back in 2003, noting that it was also available to anyone who visited the Mitsubishi Electronic Research Laboratories' lobby.

If the jury takes to Samsung's claims of prior art, it could severely cut Apple's claims against it. Even so, Cupertino's lawyers aren't going down without a fight, and still have a number of navigation and design claims that Samsung hasn't addressed. The two parties are expected to keep up the fight for about a week, we'll keep you posted on the inevitable revelations as they come.

This is not a pro or anti-teacher case.? This is not a pro or anti-emergency manager case. This case, simply put, is about the right of children to read, a right guaranteed under the constitution and laws of this state.??

?The ACLU has carefully jockeyed to buttress its argument that the right to read is a civil right for the students in Michigan. Although the ACLU acknowledges that state courts have not recognized education as a fundamental right granted by the Constitution, the ACLU points out that the Supreme Court has referred to education as ?not merely some governmental benefit which is indistinguishable from other forms of social welfare legislation.??? Additionally, the Michigan Supreme Court has declared that ?education is perhaps the most important function of state and local governments,? and the Michigan Constitution ?imposes an obligation? on the state to offer a free public elementary and high school education.?

?The ACLU lawsuit additionally cites a little used Michigan law that dictates that remediation must be offered to students who fail 4th and 7th grade literacy standards.? The law states:? Excluding special education pupils, pupils having a learning disability, and pupils with extenuating circumstances as determined by school officials, a pupil who does not score satisfactorily on the 4th or 7th grade [MEAP] (Michigan Educational Assessment Program) reading test shall be provided special assistance reasonably expected to enable the pupil to bring his or her reading skills to grade level within 12 months.??

?By any reasonable calculation, the Highland Park School Districts have failed abysmally to educate its students.? It is no accident that the ACLU chose to target this district--Its three schools are rated among the lowest in the state. In the 2011-2012 school year, only 35% of 4th graders achieved a score of ?proficient? or higher on the MEAP Reading test. ?The 7th graders fared much worse:? only 25% of them scored ?Proficient? or better on the MEAP.? Whereas 87% of fourth graders lacked proficiency in math, an appalling 93% of 7th graders lacked proficiency.? By 12th grade, 45% of seniors fail to graduate, while 90% fail at reading, 97% at math, and 100% at social studies and science. ?Yet despite the fact that most of its students are functionally and numerically illiterate, the district has failed to provide the ?special assistance? ordered by state law to bring their students? reading scores up, which are the cornerstone to the students? overall learning and education.

?The ACLU believes that the conditions in the Highland Park School District are so deleterious to its students that it is petitioning the court to take immediate action to rectify the situation by requesting a writ of mandamus. Under a writ of mandamus, a court can at any time order a state or other governing body to fulfill its legally required obligations, in this case, to teach its students how to read.? A writ of mandamus is an extraordinary legal order because it circumvents the judicial process thereby explaining the reluctance of courts to issue them.

?The Highland Park School District, which borders on Detroit and where Chrysler was once based, had boasted a strong middle class and good schools.? However, like so many communities, its fortunes have declined precipitously.? Enrollment has decreased by half since the mid 1990s, and it recently ran a more than $11 million deficit.? Its situation had become so dire that Governor Rick Snyder intervened earlier this year and appointed an emergency manager to attempt to solve the financial mess in which the district has found itself immured.? The emergency manager who has replaced the initial financial manager is looking to turn the schools over to an as yet unnamed charter school operator.?

?The ACLU?s suit is an effort to ensure that academics are part of the equation in the fixing of the school district.? One of the ACLU attorneys, Mark Rosenbaum, said that other lawsuits have resulted in changes for school districts.? A lawsuit filed in 2000 in California which claimed that students were not being given equal access to materials, school safety, and teachers resulted in better oversight of what was happening in the state?s schools. However, not everyone is rallying to the call of the ACLU.? The head of the Michigan PTA said that schools can?t ?be sued into success.?? The ACLU?s lawsuit, according to the president of the PTA, will only serve as a distraction and not improve the schools. ?The editorial staff of The Detroit News feels that the state is currently doing everything it possibly can at this point to correct the situation in the Highland Park Schools.? The blame for the debacle resides with the district, according to paper, and not the state.?

?There is clearly lots of blame to go around as to what went wrong in Highland Park.? The school board, parents, teachers, unions, the state?the list is endless.? But perhaps the lawsuit is what it will take to tip the balance and finally bring real improvement in the schools and real help to the district?s incredibly underserved and struggling students.? No one knows how this lawsuit will play out in the courts, but it bears watching. ?

Here are a few reasons to make eating as a family a priority:

  • Children learn valuable life skills ? There is benefit in children learning how to prepare and cook food, as well as how to clean the table.? Sounds crazy but I have fond memories of washing and drying dishes after meals at my grandparents? house.? May be these are fond memories because we had a dishwasher at home.
  • It?s a chance to reconnect socially ? Eating together regularly gives families an opportunity to check in with each other, share their day and laugh together.? As a basic, this is time to teach children how to carry conversations, how to ask and answer questions.
  • Build and share family traditions -? While this may be a small piece, it?s a chance to pass along blessings and prayers.? In some families a time to share recipes.
  • You can model healthy eating habits ? Parents tend to provide children a wider range of foods when families sit and eat together.? Modeling healthy eating habits is a nice, low key way to encourage them to eat.
  • You can teach and practice manners ? Table manners are a learned skill, best taught over time with lots of repitition.? Try to make this fin with related storybooks and games.
  • It?s related to better long term childhood outcomes ? Children who regularly eat at least five meals a week with their families show higher academic scores, lower rates of later behavior problems and lower rates of obesity.
